1. Acceptance & Eligibility

By accessing PostHull ("the Service"), you confirm you are at least 18 years of age. These Terms constitute a legally binding agreement. Your continued use of the Service after any updates constitutes absolute acceptance of the revised Terms.

2. "No-Warranty" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. POSTHULL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE FROM THIRD-PARTY INTERFERENCE.

3. Third-Party Platform Risks (LinkedIn)

PostHull operates in a landscape governed by third-party entities, specifically LinkedIn Corporation. You acknowledge and agree that:

• Risk of Loss: You use PostHull at your own risk. We are not responsible for account flagging, shadowing, restriction, or permanent bans imposed by LinkedIn.
• Compliance: You are solely responsible for ensuring your use of automation/scheduling complies with LinkedIn’s User Agreement.
• No Agency: PostHull is an independent software and is not endorsed, certified, or affiliated with LinkedIn in any capacity.

4. Absolute Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTHULL, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF REVENUE OR DATA.

Financial Cap: OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO POSTHULL FOR THE SPECIFIC SUBSCRIPTION TERM CURRENTLY ACTIVE AT THE TIME OF THE CLAIM. IF YOU ARE ON A FREE TRIAL, OUR TOTAL LIABILITY IS LIMITED TO ₹100 INR.

5. Your Responsibility to Indemnify Us

You agree to defend, indemnify, and hold harmless PostHull and its operators from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including LinkedIn's intellectual property or terms of use.

6. Dispute Resolution (Binding Arbitration)

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Mandatory Arbitration: Any dispute arising from these Terms shall be settled by binding arbitration in Kolkata, India, in accordance with the Indian Arbitration and Conciliation Act. The language of arbitration shall be English.

7. Termination & Force Majeure

We reserve the right to terminate your access immediately, without notice, for any conduct that we, in our sole discretion, believe is disruptive or in violation of any law.

Force Majeure: PostHull shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to changes in LinkedIn’s API, government actions, or internet-wide outages.
